Learn all the legal aspects of Medical Cann*** in India

The moment we talk about Medical Cann*** in India, the first question that is thrown at us
is if it is backed by law in the country. Well, yes, it very much is, but it comes with a list of
complicated rules and regulations that often confuse the masses. To simplify things for our
many users, we have tried to bring out the critical aspects of Medical Cann*** as per the
Indian Legal System.

Interestingly, until 1985, Marijuana was legal in India. But then, due to the western
influence driven by Ronald Reagan’s war on drugs, many countries, including India, created
laws to regulate and restrict activities related to Cann*** or Marijuana. Subsequently, the
Narcotic Drugs and Psychotropic Substances (NDPS) Act came into action in 1985. It looks
after the production, sale, and consumption of Cann***, amongst other drugs in India.
Based on the content of this Act, every Indian state has further laid down its individual rules
on the transactions related to Cann***.

Now, to understand more about Medical Cann***, it is first imperative for us to know how
the NDPS Act defines Cann***. As per the Act, Cann*** means

  1. a) Charas (unrefined or purified) is a separated resin obtained from the Cann*** plant. It
includes concentrated preparation or resin called liquid or hashish oil.
  2. b) Ganja, the flowering or fruiting top that excludes seeds and leaves which does not belong
    to the top part.
  3. c) Any dry mixture or drink made out of charas or ganja.

In easier words, Cann*** is the flowering or fruiting top of the Cann*** plant, from which
the resin (a solid or highly viscous substance of plant or synthetic origin that is typically
convertible into polymers) has not been extracted.

Now, these flowers and resin of the Cann*** plant, are banned by the NDPS Act. On the
other hand, the hemp plants or the leaves and seeds of the Cann*** plant are exempted.
This is where the catch is. The elements of Cann*** that contain all the therapeutic
properties are present in these leaves and seeds itself. They include cannabinoids such as
CBD and THC, that help in fighting various illnesses. And as per the NDPS Act, the use of
these for medical and scientific purposes is legal.

Furthermore, Cann*** Medicines have been a substantial part of Ancient Indian Ayurvedic
practices. Ayurvedic doctors strongly recommend the use of Cann*** for healing purposes.
So, the Ministry of Ayurveda, Yoga & Naturopathy, Unani, Siddha, and Homoeopathy
(AYUSH) also backs Medical Cann*** , adding more support to its legal backing.

Only a few companies have been given the license to distribute the Cann*** Medicines in
India. Anybody who is above 21 years ago age can get these medicines either by uploading a
doctor’s prescription or after an online consultation.
